Georgia Country Crypto Tax 2026: Capital Gains, Stablecoins & USDT Explained

Georgia Country crypto tax rules are simple for private investors. In Georgia (the country), resident individuals have historically paid 0% tax on gains from selling cryptocurrency, including stablecoins like USDT. The Revenue Service treats those gains as foreign-source income. Companies follow different rules, and crypto service businesses may need a VASP license.

That 0% headline is real, but it covers one specific person: a tax-resident individual trading their own assets. Change any part of that profile and the answer changes. Being paid in USDT for client work, running trades through a company, or holding coins for others each fall under a different regime.

This guide reflects the position as of 2026. Georgia has kept the individual crypto rule stable for years, but the Revenue Service can issue new rulings at any time. Confirm your situation on rs.ge before a large disposal, especially one above 100,000 EUR.

How Georgia Taxes Crypto Gains for Individuals

Georgia taxes resident individuals mainly on Georgian-source income. Foreign-source income received by an individual is generally exempt. The Revenue Service has ruled that gains from an individual selling crypto are not Georgian-source, so the georgia crypto tax rate on those gains is 0%.

The source rule behind 0%

The exemption does not come from a special crypto law. It comes from how Georgia classifies where income is earned. A ruling from the Revenue Service is the anchor, so the position depends on that ruling staying in force.

For a full breakdown of the original guidance, see our detailed guide to 0% capital gains for resident individuals.

Events covered by the exemption

For a resident individual trading their own holdings, these disposals typically fall under the 0% treatment:

  • Selling BTC, ETH or altcoins for USD, EUR or GEL

  • Swapping one token for another on an exchange

  • Spending crypto on goods or services

  • Converting volatile coins into stablecoins

Who the rule actually covers

Tax residency generally requires 183 days in Georgia within any continuous 12-month period. Our Georgia tax residency guide explains how days are counted and how to get a residency certificate.

Take a German developer who spends 210 days in Tbilisi and sells ETH at a 40,000 EUR gain. Georgia taxes that gain at 0%. Germany may still claim tax if she has not fully broken residency there.

Stablecoins and USDT: Where the Real Questions Sit

USDT and USDC are crypto assets, so selling them as a resident individual falls under the same source rule as Bitcoin. The tax question with stablecoins is rarely about gains. A stablecoin pegged to the dollar produces almost no price gain. The real issues are classification and cashing out.

When USDT is income, not a gain

Payment form does not change the nature of income. If a client pays you 5,000 USDT for design work, that is service income. It is not a capital gain.

  • Freelancers paid in USDT are taxed on the service income, often under an IE regime

  • Employees of a Georgian employer pay standard personal income tax, generally 20%, whatever the currency

  • Traders selling their own USDT holdings stay under the 0% individual rule

A Ukrainian freelancer billing EU clients in USDT, for example, would typically register as an Individual Entrepreneur. With Small Business Status, qualifying turnover is taxed at 1% up to the annual threshold. Confirm the current threshold on rs.ge.

Cashing out to GEL, USD or EUR

Georgian banks accept funds that came from crypto, but they run source-of-funds checks. Expect questions on any large incoming transfer from an exchange.

Keep these records ready before you move funds:

  • Exchange statements showing buys, sells and withdrawals

  • Wallet history linking on-chain transfers to your exchange account

  • Original purchase proof for coins bought years ago

Prepared clients often clear a bank query in 2-5 business days. Missing records can freeze a transfer for weeks.

When an LLC is the wrong choice

If you only trade your own money, a company usually makes things worse. You give up the individual 0% and step into corporate tax once you distribute. You also take on bookkeeping and monthly filings, even in months with no trades.

An LLC makes sense when you run a real crypto business with clients, staff or investors. Exchanges, custodians and brokers need a vasp license georgia issues through the National Bank of Georgia. Our VASP License in Georgia 2026 guide covers obtaining a crypto license in georgia step by step.

Who should not rely on the 0% rule

Some readers gain nothing from Georgian residency on crypto. US citizens stay taxable in the US on worldwide gains, wherever they live. Moving to Tbilisi does not change that.

The same applies if your home country still treats you as resident. Common triggers include:

  • Family home kept open in your old country

  • Spouse or children still living there

  • Main economic ties, such as a business you still run there

In these cases, the 0% Georgian rate is real but irrelevant. Your old country taxes the gain anyway.

Crypto Income That Is Not a Capital Gain

A freelance developer from Poland invoices a US client 4,000 USD per month and gets paid in USDT. None of that is a capital gain. It is business income, and Georgia (the country) taxes it under different rules from the trading gains covered earlier.

Payment for services in crypto

Being paid in crypto does not change what the payment is. A service invoice settled in USDT is service income. It follows the rules of whatever structure you invoice through.

Individual Entrepreneurs with small business status

An Individual Entrepreneur with small business status pays 1% on turnover up to the annual threshold. Crypto receipts count toward turnover at their GEL value on the day you receive them. Confirm the current threshold on rs.ge before planning around it.

For the Polish developer, that means 48,000 USD a year of USDT receipts gets converted to GEL and taxed at 1%. The later sale of that USDT is a separate question. If you hold it and it does not move in value, there is no extra gain to think about.

Employees paid in crypto

Georgian employment income is taxed at a flat 20% personal income tax, withheld by the employer. The employer must value crypto salary in GEL on the payment date. It withholds and remits the tax in GEL, even if the employee receives tokens.

Staking, mining and airdrops

These are the areas where Georgian practice is least settled. Rewards are not a disposal of an asset you bought. They are new tokens arriving in your wallet.

Treatment can depend on:

  • Scale, since occasional rewards differ from an organised business activity

  • Location of the hardware or validator, especially for mining done in Georgia

  • Structure, because a company recognises income differently from an individual

If staking or mining is a material part of your income, request a written position from the Revenue Service. Do not assume the 0% treatment of foreign trading gains carries over automatically.

When crypto activity becomes a business

A retired investor who buys Bitcoin twice a year is not running a business. A trader who runs a Georgian OTC desk for other people almost certainly is. Serving clients, holding their funds or exchanging on their behalf points toward licensing, which our VASP License in Georgia Country 2026: Complete Guide for Crypto Businesses covers in detail.

How to Document Your 0% Position Step by Step

A Georgian tax resident who sells 200,000 USD of ETH on a foreign exchange may owe nothing in Georgia. Proving that later is a separate job, and it starts long before the sale.

1. Secure tax residency first

Tax residency generally requires 183 days in Georgia within any continuous 12-month period ending in the tax year. Count days from passport stamps, not memory. Our guide to Georgia tax residency requirements and benefits explains the alternative routes.

2. Request a tax residency certificate

The Revenue Service issues certificates on request through rs.ge. The certificate covers a specific period. Request one for each year you rely on Georgian residency.

This document matters most abroad. Your former country's tax office, or a foreign exchange, will ask for it before accepting that you left.

3. Build a transaction record as you go

Export statements from every exchange at least once a quarter. Exchanges close, change jurisdictions or delete old data. A record you can no longer download is a record you do not have.

Your file should include:

  • Exchange statements showing every buy, sell and swap with timestamps

  • Wallet addresses you control, with on-chain transfer history

  • Cost basis for each position, in USD and GEL

  • Counterparty details for any P2P or OTC trade

4. Convert values at the NBG rate

The National Bank of Georgia publishes an official GEL exchange rate every day. Use the rate for the transaction date when you report anything in GEL. For a token priced in USD, convert USD to GEL with that rate.

5. Prepare the bank off-ramp

Georgian banks routinely ask where crypto proceeds came from before crediting a large deposit. A typical request covers the exchange statement, the withdrawal transaction hash and proof of the original purchase. Sending the pack upfront can turn a two-week review into a few business days.

If you still need an account, see our page on [opening a bank account in Georgia online](https://www.gegidze.com/opening-a-bank-account-in-Georgia Country -online). Ask the bank about crypto-origin funds before you open it, not after.

What each structure costs to run

A resident individual trading only foreign gains has almost no running cost. A company adds monthly declarations, payroll if you hire, and an accountant. Market rates for crypto-capable bookkeeping in Tbilisi tend to run several times higher than for a simple service LLC, because every wallet needs reconciling.

The LLC's corporate tax works on distribution. Our corporate income tax guide explains which payments count as distributed profit. Some of them, such as certain non-business expenses, catch founders by surprise.

Switching structures mid-year

Moving a portfolio from your personal wallet into a new LLC is a transfer between two taxpayers. The company records the tokens at market value on the transfer date. That value becomes its cost basis.

The reverse move needs equal care. Taking tokens out of an LLC to your personal wallet is generally a distribution. Plan the exit before you incorporate, not after the portfolio has grown.

A worked example

A Ukrainian founder in Batumi holds 90,000 GEL (about 30,000 EUR, at early-2026 rates) of BTC personally and earns IT income through an LLC. Keeping the BTC personal preserves the 0% treatment on foreign trading gains. Keeping the IT revenue in the LLC lets profit grow untaxed until payout. Mixing the two would add complexity and buy no benefit.

Frequently Asked Questions

For a resident individual with foreign-source gains, the swap usually falls under the same 0% treatment as a sale for cash. For an LLC, the swap is a disposal in the books, but no corporate tax arises until profit is distributed. Record the GEL value of both legs on the swap date, because a later audit will ask for it.

Exempt foreign-source gains alone generally do not create a Georgian filing obligation. If you also have taxable Georgian income, such as rental income, the annual personal income tax declaration is due by 31 March of the following year. Missing that deadline brings penalties, so confirm the current amounts on rs.ge.

Residency is tested over any continuous 12-month period ending in the tax year. Someone who arrived in March 2025 and left in November 2026 may still count as a Georgian resident for 2026. What matters more is when your new country treats you as resident, since a sale after that date can be taxed there.

The Revenue Service issues individual tax rulings on a specific set of facts you describe. A ruling is useful for staking, mining or unusual token structures where public guidance is thin. Allow several weeks, and describe your facts precisely, because the ruling only protects the situation you disclosed.

Yes, but the company still runs payroll in GEL. It values the USDT at the NBG-converted rate on the payment date, withholds 20% income tax, and remits that tax in GEL from its own funds. Paying the full token amount without withholding leaves the company owing the tax plus penalties.

They often accept them, but P2P sales are harder to document than exchange withdrawals. Banks typically want the counterparty's details, a chat or contract record and the on-chain transaction. Cash P2P deals with no paper trail are the most likely to be rejected, so route large sales through a regulated exchange.

The Georgian treatment looks at the gain when you sell as a resident. Your former country may still claim tax on gains accrued before departure, through an exit tax or deemed disposal rule. Germany, Canada and Spain are among the countries with exit rules worth checking. Get a valuation of your portfolio on the day you leave, because both countries may ask for it later.
